Who processes your data?
1. Introduction
This privacy statement explains everything about which data of yours is processed as a customer or as a user of the GENTS webshop. It also states in this privacy statement why and for how long your data is processed and what your rights are regarding the processing. You will also receive information about the parties we cooperate with and our security system. At the bottom of this document is a glossary with some important terms.

This is the privacy statement of GENTS B.V. (Chamber of Commerce number 50187465). This privacy statement applies to every processing of personal data of our (potential) customers and users of our websites, including the webshop at gents.nl
For the sake of transparency, we also provide information about the processing of data other than personal data. Think, for example, of information about our customer service. From now on, all personal data and other data are collectively referred to as ādataā. To align as much as possible with your personal needs and wishes, we may adjust this privacy statement. The most current privacy statement can be found on the website gents.nl.
Your data is not processed without reason and only if necessary for specific purposes. Your data will never be sold to third parties. If you have complaints, questions, or remarks about this privacy statement, please feel free to contact our customer service.

3. Who is responsible for processing your data?
GENTS is responsible for the processing and protection of your data. GENTS sets out in this privacy statement how and which data of yours is processed. Our webshop contains links to our suppliers of items. We are not responsible for the processing of your data via these websites. This privacy statement does not apply to those.

Create and manage account

1. What does this mean?
Before you can buy products at GENTS you need your own account. You can create this account on our website. Once you have your own account on our webshop, you can log in with your email address and password. Additionally, you can manage your own account and change or delete data.

2. What data do we process from you?
To create your account we need the following information:
- Your first name, initial(s), last name, gender, and email address (mandatory)
- You are also required to provide your date of birth.
- Phone number is not mandatory
It is possible to create an account if you are under 18, however the minimum age limit is 16 years.
We need your date of birth, among other things, to verify the following:
- A minor may not enter into agreements unless he/she has permission from his/her parents/guardian.
The law assumes that consent is given when it concerns an agreement where it is socially customary for a minor to enter into that agreement. For example, it is customary for a minor of 16 years to buy clothing. This means that someone from 16 years old can purchase items from us.
Postal code and house number (optionally with addition):

- The password you entered must be confirmed for security reasons
- Your password must contain at least 8 characters
- To create a strong password you can combine uppercase letters, lowercase letters, numbers and/or special characters

Processing for (further) use of your GENTS account:

- Info about My GENTS, changing data, subscribing to newsletter and reporting complaints
- Email address for email preferences. Here you can indicate whether or not you want to be kept informed about offers and promotions from GENTS

Customer service and general information
Processing for (further) use of your GENTS account:
- Info about placing orders, tracking, canceling, costs and safety of shopping
- Info about delivery time and delivery times, delivery address, picking up packages, tracking packages etc.
- Info about free returns, returns not refunded, return conditions, exchanging item(s) etc.
- Info about returns, having items repaired, proof of purchase, repair costs etc.
- Info about delivery of large items, delivery on another floor, making items ready for use etc.
- Info about payment methods, payments, refunds, preferences, payment arrears etc.
- Info about the app and its possibilities
- Info about promotions via Instagram, Facebook etc.

4. What is the basis for this processing?
The processing mentioned under § 6.2 is necessary for the execution of the agreement between you and GENTS. This is to be able to deliver and process your orders.

5. How long do we keep your data for this purpose?
The account data including your preferences that you have indicated are only kept as long as you actively use the account. When you have not used your account for 5 years, your account data will be deleted under certain conditions. We keep your data about orders and invoices for 7 years due to legal periods.
It is possible to change your data and settings of our services and newsletters in your GENTS account. If you adjust this, it will be processed as soon as possible. This happens within a maximum of 2 weeks after you have adjusted it. If you delete your account, we will delete your account data within 4 weeks.
Buying items and having them delivered
1. What does this purpose involve?
Through our webshop you can buy items and have them delivered to your home or collected at a PostNL point. Only you can then pick up the package at a PostNL point. Ordering items at GENTS is generally possible from the age of 16.

2. What data do we process from you?
From the moment you visit our website, we process certain data about you. If you want to order items and have them delivered to your home or collected at a PostNL point, we process the following transaction data from you:
Characteristics of placed orders: Number, type, prices, availability of items, type of shipping, VAT and shipping costs
Login details: To be able to buy items you need a Mijn GENTS account and must be logged in
Your GENTS account: You can log in with your email address and password
Delivery method: Parcel post, delivery to delivery address or collection at PostNL point.
Delivery address and time: Name, address, town, delivery date and time if possible
Pickup confirmation: To communicate about your order by email or SMS (for SMS you must provide your phone number)
Account number and payment details: We process data related to payment
Method of payment: In advance with iDeal, Credit card

Once you have opened a GENTS account and purchased one or more items, we can then send you offers and information about our items and services via, for example, email. We can also use your data to show you offers and information on social media. Furthermore, we process among other things your transaction data for internal market research.

4. How long do we keep your data for this purpose?
The data mentioned under § 7.2 we generally keep for 7 years because we are required to keep this data due to legal periods. For the retention periods of your account, adjustment or deletion of data from your account, change of your settings or termination of your account we refer to § 6. Important data for the functioning of our shop, including items added to the wish list and shopping cart, your login status and recommendations, including items, we keep for a maximum of 1 year from the last logged-in visit to our shop.

What does this mean?

1.1. Functionality
When you visit our shop, we process data about you, such as your IP address and the use of our services. We need this data to offer the functionality of our shop. In addition, we can use this information to improve the webshop and make it more user-friendly.
1.2. Adapting to click and buying behaviour
GENTS uses your data to tailor its webshop to your click and buying behaviour. Furthermore, your data is also used to show relevant offers and advertisements in our shop and through third-party websites. Finally, segments can be used for campaigns on our websites. GENTS can link the data from your website visit to your GENTS account, transaction data, and data we have received from you based on customer satisfaction reviews. This data is used to make shown offers and advertisements more relevant and personal. In addition, this data is analysed. The results can be used for segmentation to personalise the shop and communications.

Marketing
1. What does this purpose involve?
To build a relationship with you, we engage in various forms of marketing. We do this by contacting you directly through different channels such as e-mail, mail, SMS, push notifications, and social media. Additionally, recommendations of items and advertising banners on our and third-party websites are also channels we use for marketing. We prefer to make the advertisements and offers as relevant as possible for you. For this, we need data that helps us determine your interests. We do this by analysing your behaviour through the data we have collected. This is done based on profiling.

If you have created an account (§ 6) and have purchased one or more items (§ 7), we can then select you for marketing purposes.
At the moment we have received electronic contact details in connection with the sale of products, we may use these contact details under the law without further permission to send commercial communication for āour own similar items or servicesā. You can object to the use of your electronic contact details for marketing purposes.

Taxes, administration, etc.
1. What does this purpose involve?
For certain purposes, we must process some of your data based on legal obligations. Think of administration, bookkeeping, and tax purposes. We must provide the tax inspector with the data that may play a role in taxation at GENTS. Our accountant also has access to our administration to carry out the legal audit of our annual accounts. As a result, it may sometimes be necessary to share certain data of yours with third parties.
2. What data do we process from you?
This depends greatly on the legal obligation and the purpose. We may not process more or different data than is necessary for fulfilling the legal obligation.
3. What is the basis for these processes?
The processes referred to under § 10.2 are necessary to comply with legal obligations that rest on GENTS.
4. How long do we keep your data for this purpose?
This depends on the purpose. As a rule, this is kept for 5 years.
How do we protect your data?
- We ensure that your account is secured and that no one from outside or inside can log in and access your data. For example, your password is stored with encryption on our side.
- We continuously monitor whether (secret) break-in attempts are being made.
- We repair vulnerabilities and take measures in case of a break-in.
- We have many systems that communicate with each other. When we transfer your data from one system to another, this is done safely and in a controlled manner.
- Only GENTS employees who need it for the performance of their duties can view your data for specific purposes.
- Third parties who need access to your data are required to take appropriate technical and organizational security measures and to bind their employees to confidentiality.
- We protect our systems against malware, viruses, ransomware, and hacking software.
- We use the latest technologies to guarantee the availability and safety of our shop.
- We ensure that we are up-to-date with our software and other technologies.
- We regularly provide our website with automated security scans.
- Communication via the website or email takes place encrypted, controlled, and safely.
Your rights
Right to information
We are obliged to inform you about our identity, which data we process from you, for how long, for what purposes, on what basis, and to whom we provide your data. You can find all this information in this privacy statement. If you want more information, you can contact us (§ 4 and § 5). We will provide the information free of charge, unless your request is clearly unfounded or excessive. In that case, we will not comply with your request or, if we do, charge administrative costs.

You have the right to access your data. Among other things, you have the right to obtain from GENTS confirmation whether they process data about you, and if so, which data, what the purposes of the processing are, to which parties your data are provided, how long your data are processed, and the available information about the origin of the data (if the data do not come from yourself). You do not have to give a reason for a request for access. The right of access only concerns access to your own data. GENTS may ask you to send a copy of your driving license, identity card, or passport for identification.

You can ask GENTS to immediately correct your data if these data are not correct. You also have the right to complete incomplete data by sending an additional statement or letter to GENTS. In your My GENTS account, you can change many data yourself.

Right to data portability
You have the right to data portability. This means that you can request GENTS to receive your data. You can then save this data for personal use. You can also pass your data on to another retailer or ask GENTS to do this for you (as far as this is technically possible). You have the right to data portability only with regard to data you have provided to GENTS yourself and if the processing is based on your consent or an agreement to which you are a party. You can download your data in your My GENTS account.
